Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DriveFlow Insight platform, website, and related services (collectively, the "Service") provided by Drive Flow Insight Co., Ltd. ("DriveFlow Insight", "we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing our website, or using any part of the Service, you confirm that you are at least 20 years old, have the legal authority to enter into this agreement on behalf of yourself or your organisation, and agree to comply with these Terms and all applicable Thai laws and regulations.
2. Description of Service
DriveFlow Insight is a fleet intelligence Platform as a Service (PaaS) that provides real-time driver behaviour analytics, health monitoring, vehicle management, and related tools delivered via a web portal and mobile application. The Service is designed for commercial fleet operators, transport companies, and logistics providers operating primarily in Thailand and South-East Asia.
3. Subscription and Payment
Access to the Service requires a paid subscription. Pricing, billing cycles, and available plans are published on our website and may be updated with 30 days' notice. Fees are non-refundable except as required by applicable law or expressly stated in your subscription agreement. Failure to pay on time may result in suspension or termination of access.
4. Acceptable Use
You agree not to: use the Service in any way that violates applicable law; reverse-engineer, decompile, or attempt to extract the source code of the platform; use automated tools to scrape or extract data beyond authorised API access; upload or transmit malicious code, viruses, or harmful content; impersonate another person or organisation; or share login credentials with unauthorised persons. We reserve the right to suspend or terminate accounts that violate these restrictions.
5. Intellectual Property
All intellectual property rights in the Service — including software, algorithms, design, trademarks, and documentation — belong to Drive Flow Insight Co., Ltd. or its licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service solely for your internal business operations. Nothing in these Terms transfers ownership of any intellectual property to you.
6. Data Ownership
You retain ownership of the operational data your organisation uploads or generates through the Service ("Customer Data"). You grant us a limited licence to host, process, and display Customer Data solely to operate and improve the Service. We will never sell your Customer Data to third parties. Please refer to our Privacy Policy for details on how we handle personal data within Customer Data.
7. Warranties and Disclaimers
The Service is provided "as is" and "as available". We warrant that we will use commercially reasonable efforts to maintain 99.5% monthly uptime for core platform features. Beyond this, we disclaim all warranties, express or implied, including but not limited to fitness for a particular purpose and non-infringement, to the maximum extent permitted by Thai law.
8. Limitation of Liability
To the maximum extent permitted by applicable law, DriveFlow Insight's aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the fees you paid us in the three months immediately preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages, including loss of revenue, loss of data, or business interruption.
9. Termination
Either party may terminate the subscription at the end of any billing cycle. We may terminate or suspend access immediately and without notice if you materially breach these Terms, fail to pay fees, or if we are required to do so by law. Upon termination, your right to access the Service ceases. We will retain your Customer Data for 90 days post-termination, after which it will be permanently deleted unless otherwise required by law.
10. Governing Law and Disputes
These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising out of or in connection with these Terms shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to and finally resolved by the courts of competent jurisdiction in Nonthaburi Province, Thailand.
11. Changes to These Terms
We may revise these Terms at any time by posting the updated version on our website with a new "Last updated" date. Material changes will be communicated to registered users via email at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the new Terms.
